1. Service Description

Ovation Gram provides a custom telegram delivery service to theaters and performance venues in New York City and surrounding areas. We create personalized keepsake boxes containing your custom message and hand-deliver them to recipients at stage doors for delivery to dressing rooms.

Our services include:

  • Custom message creation and printing

  • Presentation-ready keepsake box assembly

  • Hand delivery to stage doors at Broadway, Off-Broadway, and other performance venues

  • Coordination with theater staff for dressing room delivery

2. Order Process

Placing an Order:

  • You provide the recipient's name, performance details (show, date, venue), and your custom message

  • You pay the service fee ($30 for Manhattan delivery; additional fees may apply for other locations)

  • We confirm your order via email

Order Confirmation: Orders are confirmed once payment is processed. You will receive an email confirmation with your order details. Please review carefully and contact us immediately if any information is incorrect.

3. Pricing and Payment

  • Base Price: $30 for Manhattan delivery

  • Additional Locations: Pricing varies by location and will be clearly stated at checkout

  • Payment: All payments are processed securely through PayPal

  • Currency: All prices are in U.S. Dollars (USD)

Prices are subject to change, but you will always be charged the price displayed at the time you place your order.

4. Custom Orders and Content

Your Responsibilities:

  • You are responsible for the accuracy of all information provided (recipient name, show, date, venue, message)

  • You warrant that your message content does not violate any laws or third-party rights

  • You agree not to include content that is defamatory, obscene, threatening, harassing, or otherwise inappropriate

Prohibited Content: We reserve the right to refuse any order containing:

  • Hate speech, threats, or harassment

  • Sexually explicit or obscene material

  • Content that violates intellectual property rights

  • Illegal content or content promoting illegal activity

  • Material that could harm our reputation or relationships with venues

5. Delivery

Delivery Process:

  • We hand-deliver your Ovation Gram to the stage door of the specified venue

  • Theater staff delivers the box to the recipient's dressing room

  • Delivery timing depends on theater policies and performance schedules

We Cannot Guarantee:

  • That the recipient will be present at the performance

  • That theater staff will permit delivery (theater policies vary)

  • Exact delivery time to the dressing room

  • That the recipient will open or acknowledge the Ovation Gram

We Are Not Responsible For:

  • Non-delivery if the recipient is not in attendance at the specified performance

  • Non-delivery due to theater policies that prevent backstage access

  • Delays caused by theater staff or backstage protocols

  • Incorrect information provided by you (wrong show, date, venue, or recipient name)

6. Refund and Cancellation Policy

All sales are final. Ovation Grams are custom-created specifically for your recipient and performance.

Cancellations:

  • Orders may be cancelled for a full refund up to 48 hours before the scheduled performance

  • Cancellations made less than 48 hours before the performance are non-refundable

  • To cancel, contact us immediately at [your email address]

Refunds for Our Errors: If we fail to deliver your Ovation Gram due to our error or negligence, we will offer:

  • A full refund, OR

  • The option to reschedule delivery to another performance at no additional charge

No Refunds For:

  • Recipient not in attendance

  • Theater policies preventing delivery

  • Incorrect information you provided

  • Change of plans after the 48-hour cancellation window

7. Photography and Marketing

With your explicit consent at checkout, we may photograph the outside of your Ovation Gram (showing the recipient's name and venue) for marketing purposes on our website and social media starting 30 days after delivery. Message content and sender information will always remain confidential.

We Will Never Disclose:

  • Your identity as the sender

  • The content of your message

  • Any personal information about you

You may opt out of photography consent at the time of purchase.

8. Intellectual Property

Your Content: You retain all rights to the message content you create. By submitting your message, you grant us a limited license to print, display, and deliver it as part of our service.

Our Content: All content on ovationgram.com, including text, graphics, logos, images, and software, is the property of Ovation Gram and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our written permission.

9. Limitation of Liability

To the fullest extent permitted by law:

  • Ovation Gram's total liability for any claim related to our services shall not exceed the amount you paid for that specific order

  • We are not liable for indirect, incidental, consequential, or punitive damages

  • We are not responsible for the actions or omissions of third parties (theater staff, venue management)

  • We are not liable for emotional distress, disappointment, or lost opportunities

10. Indemnification

You agree to indemnify and hold harmless Ovation Gram, its owners, employees, and agents from any claims, damages, or expenses arising from:

  • Your violation of these Terms of Service

  • Your message content

  • Your violation of any third-party rights

  • Inaccurate information you provided

11. Venue Relationships

We maintain professional relationships with theaters and venues. These relationships are independent, and we are not agents, employees, or representatives of any theater or venue. Theaters may change their policies regarding backstage deliveries at any time.

12. Privacy

Your use of our services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. Please review our Privacy Policy at ovationgram.com/privacy-policy.

13. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website with an updated "Last Updated" date. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.

14. Termination

We reserve the right to refuse service or cancel orders at our discretion, including if:

  • You violate these Terms of Service

  • You provide false or misleading information

  • Your message content is inappropriate or prohibited

  • We are unable to fulfill the order due to circumstances beyond our control

15. Governing Law

These Terms of Service are governed by the laws of the State of New York, without regard to conflict of law provisions. Any disputes shall be resolved in the courts located in New York County, New York.

16. Severability

If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms of Service, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Ovation Gram regarding our services.
